Reservations & Rental Agreement

The Village at Winona® agrees to rent to the undersigned Renter the following facilities, at the rental rates indicated in this agreement.

Damage/Cleaning Deposit $200 (Returned after final inspection)

The facilities include the use of "The Grounds" which are defined as that area bordered by the Mikesell Fountain area to Ninth Street, and from Park Avenue to the sidewalk along the top of the hill on the east side of the park. "The Grounds" are available for non-exclusive use and may be shared or used by others, with rental of any other facilities. Rental also includes up to 200 invitation sized maps of The Village at Winona.

RESPONSIBILITIES OF RENTER:

The person renting the facilities (Renter) shall be responsible to see that the area is vacated no later than 11:00 p.m. on the date of rental; that any noise or sound created by the use of the facilities be kept at a level sufficiently low as to not interfere with neighbors; that trash be cleaned up prior to conclusion of the use; and that persons invited by Renter be responsible and respectful of the property and neighbors' rights.

SPECIFIC PROHIBITIONS:

The Village at Winona® has specific prohibitions for the use of the facilities as follows: no events between 11:00 am - 1:00 pm and 5:00 - 7:00 pm on Saturdays, no tobacco; no alcohol without written approval; no animals; no fireworks; nothing shall be attached or affixed to any tree or plant; nothing shall be affixed or attached to any building without approval; no use of the Beyer Home porch, steps, general area or trespassing on or over the surrounding property; no digging, transplanting, or disturbance of vegetation; no vehicles on the turf or sidewalks; no swimming or fishing in the swan pond; no trespassing into or upon the Mikesell Fountain or surrounding plantings; no parking in BoatHouse Restaurant parking lots and other restricted or dedicated areas; no parking or loading or unloading of people or property from Chestnut Street; no decoration or similar property is to be placed before 5:00 P.M. on the day preceding the event. Tents or other temporary structures must be approved by The Village at Winona® and be placed no more than 24 hours preceding the event and removed within 48 hours after the event.

AGREEMENT OF RESPONSIBILITY:

Renter understands and agrees that the premises are being rented "as is." Renter understands and agrees that this is an outdoor venue and subject to weather conditions. Renter agrees that The Village at Winona® shall have no responsibility regarding decorative elements placed by the Renter or for debris or damage caused by weather related incidents. Renter agrees to be responsible for the facilities while being used, including responsibility for the behavior of persons present, and the preservation of the facilities. Renter agrees to indemnify The Village at Winona®, for any loss, damage, or harm to the facilities or grounds and to protect and indemnify against any claims of persons present during the term of rental, including attorney fees and cost of defense.

DEPOSIT:

Renter agrees to pay a deposit of $ 75.00 which is not refundable. The deposit secures, saves, and reserves the use of the rented facilities on the date indicated. Full payment is expected no later than immediately prior to the event or in the case of a Saturday or Sunday event, by 5:00 p.m. on the preceding Friday.
